Privacy and Confidentiality of Personal Health Information
Privacy is a priority of Oberlin
College (the "College"). Even prior to the Health Insurance
Portability and Accountability Act of 1996 ("HIPAA") and its
implementing regulations, the College sought to protect the confidentiality
of all health information to which it had any access.
The College sponsors the Oberlin College Health Plan for Faculty and Staff,
and the Oberlin College Voluntary Vision and Voluntary Dental plans (each
of which is referred to herein as the "Plan"). The Plan has
certain protected health information ("PHI"), which generally
is information relating to an individual's eligibility for health care
and payment for the provision of health care where the health information
identifies the individual or it is reasonable to believe information can
be used to identify the individual.
In the course of administering the Plan, some of the College's workforce
may have access to PHI. HIPAA restricts the College's ability to use and
disclose PHI.
The College has established the following policies and procedures (the
"Privacy Policy") with respect to PHI. To the extent that this
Privacy Policy conflicts with HIPAA, the requirements of HIPAA shall control
the College's obligations. No third party rights (including, but not limited
to, rights of Plan participants, beneficiaries, covered dependents, or
business associates) are intended to be created by this Privacy Policy.
The College reserves the right to amend or change this Privacy Policy
at any time (and even retroactively) without notice. The College will
notify if there are changes. To the extent this Privacy Policy establishes
requirements and obligations above and beyond those required by HIPAA,
the Privacy Policy shall be aspirational only and shall not be binding
upon the College.
